These terms apply to your use of lyftmoney.com.au and any subdomains (the website), operated by Lyft Capital Pty Ltd (ABN 18 623 527 775), trading as Lyft Money and including our Lyft Financial services (Lyft Money, we, us, our), holder of Australian Credit Licence 541052. By using the website you agree to these terms and to our Privacy policy. If you do not agree, please do not use the website.
1. What we do
Lyft Money is a finance broker. We provide credit assistance by helping businesses and individuals compare and apply for finance from a panel of lenders and other product providers. We are not a lender, we do not make credit decisions and we do not guarantee that any lender will approve an application or offer a particular rate, amount or term.
2. General information only
The information on the website, including product descriptions, rates, fees, eligibility notes, FAQs, guides, articles, industry pages and comparisons, is general information. It has been prepared without taking into account your objectives, financial situation or needs. It is not personal financial, credit, legal, tax or accounting advice. Before acting on anything on the website you should consider whether it is appropriate for you and, where relevant, obtain advice from a qualified adviser. Comments about tax treatment, such as GST, depreciation, fringe benefits tax or instant asset write-off, are general and depend on your circumstances; confirm them with your accountant.
3. Rates, repayments and calculators
Rates, fees and repayment figures shown on the website are indicative, change without notice and depend on the lender, the product, the asset, the term, your credit profile and lender assessment at the time of application. Calculators and estimates on the website are provided as a guide only. They use simplified assumptions, exclude fees and charges unless stated, and do not constitute an offer of finance or a quote. Actual repayments will be confirmed by the lender in its loan contract.
Where a comparison rate is shown for consumer credit, it is true only for the example given and may not include all fees and charges. Different amounts and terms will result in different comparison rates. Costs such as redraw fees or early repayment fees, and cost savings such as fee waivers, are not included in the comparison rate but may influence the cost of the loan.
4. Enquiries and applications
Submitting an enquiry through the website is not an application for credit and does not create a contract for finance. Nothing is submitted to a lender until you ask us to proceed. When we provide credit assistance for consumer credit we will give you our credit guide and any other documents required by the National Consumer Credit Protection Act 2009 (Cth) at that time. Approval of any finance is subject to the lender's assessment and its terms and conditions.
You must ensure that any information you give us is accurate, complete and not misleading, and that you are authorised to provide it, including information about a business, a co-borrower or a guarantor.
5. Accuracy and availability
We take care to keep the website accurate and up to date, but we do not warrant that it is complete, current or free from errors, or that the website will be available without interruption. We may change, suspend or remove any part of the website at any time. Lender names, logos, awards and review counts are shown as at the date they were last updated.
6. Reviews, testimonials and case studies
Reviews and testimonials reflect the experience of the individuals who provided them and are not a guarantee of the outcome you will receive. Case studies describe actual transactions with details changed or generalised to protect client confidentiality, and outcomes depend on individual circumstances.
7. Intellectual property
The website and its content, including text, photographs, graphics, logos, calculators and code, are owned by or licensed to Lyft Money and protected by copyright and trade mark law. You may view, download and print content for your personal or internal business use. You must not otherwise reproduce, adapt, publish, distribute or commercially exploit any part of the website without our written permission. Lyft Money and Lyft Financial are trading names of Lyft Capital Pty Ltd. Lender and partner names and logos belong to their respective owners.
8. Third-party links and content
The website contains links to third-party websites, including lenders, credit reporting bodies, regulators and review platforms. Those sites are not under our control, and we are not responsible for their content, availability or privacy practices. A link does not imply endorsement.
9. Acceptable use
You must not use the website for any unlawful purpose, attempt to gain unauthorised access to any part of it, interfere with its operation, introduce malicious code, scrape or harvest data, or submit false, misleading or fraudulent enquiries.
10. Liability
Nothing in these terms excludes, restricts or modifies any right or remedy you have under the Australian Consumer Law or any other law that cannot be excluded. Subject to that, to the maximum extent permitted by law, we exclude all warranties not expressly set out in these terms and we are not liable for any loss or damage, including indirect or consequential loss, loss of profit, business or data, arising from your use of or reliance on the website or its content, or from any decision you make based on it. Where liability cannot be excluded but can be limited, our liability is limited to resupplying the relevant service.
